June 26, 2019 Opinion or Order Filing 6 ORDER: The Court finds that Petitioner's claims are more properly reviewed under 42 U.S.C. 1983, rather than 28 U.S.C. 2254. The Court therefore construes the instant Petition for Writ of Habeas Corpus as a prisoner civil rights action. For the reasons stated herein, Petitioner is DENIED permission to proceed in forma pauperis and he must pay the full filing fee of $400.00 if he desires to pursue his complaint. Plaintiff is admonished that frivolous lawsuits consume inordinate amounts of scarce judicial resources. Further abuse of the judicial process by filing frivolous and malicious lawsuits will result in the imposition of sanctions, including monetary sanctions and/or a complete bar to filing civil actions in this Court. It is, therefore, ORDERED: (1) The Clerk shall change the nature of suit in this civil action to reflect that it is a prisoner civil rights action brought pursuant to 42 U.S.C. 1983. (2) Petitioner shall pay the filing fee of $400.00 within twenty (20) days of the date of this Order. The failure to timely pay the full filing fee shall result in the dismissal of the instant civil action without further notice. (Ordered by Senior Judge Sam R Cummings on 6/26/2019) (jak)
