May 27, 2020 Opinion or Order Filing 4 Order to Open a New Civil-Rights Action and Notice of Deficiency: Plaintiff filed a copy of an I-60 medical request dated May 12, 2020, and an offender grievance form dated April 21, 2020, complaining that he has been trying to get medical attention at the Middleton Unit of the Texas Department of Criminal Justice (TDCJ) since March 27, 2020 24. The Court finds that the documents should be construed as a new civil-rights action and proceed independent of this case. The Clerk is directed to (1) unfile Dkt. No. 24 from the docket in this case; (2) open a new civil-rights action under 42 U.S.C. 1983 using the I-60 and grievance form as the original complaint; and (3) docket a copy of this order in the new case. If Plaintiff wishes to proceed with his Middleton Unit claims, Plaintiff must, within 20 days from the date of this Order, pay the filing fee or file an Application to Proceed in Forma Pauperis together with certified statement of his inmate trust account. Failure to comply with this order may lead to dismissal for failure to prosecute pursuant to FRCvP 41(b).
