November 23, 2020 Opinion or Order Filing 7 ORDER: Petitioner filed a "Motion to be Granted Voluntary Dismissal with Permission to Reopen at Future Date 6 . The motion appears to be in response to the Show Cause Order entered on October 26, 2020. Federal Rule of Civil Procedure 41 (a) permits a plaintiff to dismiss an action without a court order by filing a notice of dismissal before the opposing party serves an answer. The Defendants have not been served in this case. The Court finds that Petitioner's motion serves as a self-executing notice of voluntary dismissal under Rule 41 (a), and this case is dismissed without prejudice. It is, therefore, ORDERED that if Plaintiff wishes to pursue his civil rights complaint, he shall have twenty (20) days from the date of this Order to file his prisoner civil rights complaint using the court-approved form and pay the $400.00 filing fee or file an application to proceed in forma pauperis and a certificate of his inmate trust account.
