ORDER DENYING MOTION FOR COUNSEL #1 and, INFORMING DEFENDANT OF CHARACTERIZATION of MOTION as a MOTION SEEKING RELIEF UNDER 28 U.S.C. 2255. For the reasons explained in this Order, it is ORDERED that Regan's handwritten motion to appoint counsel is DENIED. It is further ORDERED that the handwritten motion to appoint counsel is also construed as a motion seeking relief under 28 U.S.C. 2255. The clerk of Court is directed to forward to defendant Regan a blank form motion under 28 U.S.C. 2255 (with this new civil number thereon). It is further ORDERED that if defendant Regan wishes to withdraw the motion construed as seeking relief under 28 U.S.C. 2255, she must so inform the Court by filing a written notice with the clerk of Court within thirty (30) days of the date of this order. It is further ORDERED that if defendant Regan wishes to pursue relief through a motion under 28 U.S.C. 2255, she must complete and file, within thirty (30) days of the date of this order, the completed form motion under 28 U.S.C. 2255 provided to her by the clerk of Court. **Clerk's note: a blank form 28 U.S.C. 2255, with this civil case number added, has been sent to Petitioner under cover of this Order.
