May 5, 2021 Opinion or Order Filing 3 ORDER DENYING MOTION FOR COUNSEL #1 and, INFORMING DEFENDANT OF CHARACTERIZATION of MOTION as a MOTION SEEKING RELIEF UNDER 28 U.S.C. 2255. For the reasons explained in this Order, it is ORDERED that Regan's handwritten motion to appoint counsel is DENIED. It is further ORDERED that the handwritten motion to appoint counsel is also construed as a motion seeking relief under 28 U.S.C. 2255. The clerk of Court is directed to forward to defendant Regan a blank form motion under 28 U.S.C. 2255 (with this new civil number thereon).
