Filing 6 FEE ORDER. Plaintiff did not pay the filing fee. Instead, he filed an application to proceed in forma pauperis (IFP) with a certificate of his inmate trust account. However, the Court finds that Plaintiff's IFP application must be denied because he is barred from proceeding IFP under the three-strikes provision of 28 U.S.C. 1915(g). The Court finds that Plaintiff has failed to allege any facts that show he was in imminent danger of serious physical injury at the time he filed his complaint. As a result, he cannot proceed without full prepayment of the filing fee. The Court therefore orders: Plaintiff's application to proceed IFP #4 is denied. Plaintiff must pay the $402.00 filing fee within 20 days of the date of this order if he wishes to pursue this civil action. Failure to pay the fee will result in the dismissal of Plaintiff's complaint for want of prosecution without further notice. Service of process shall be withheld pending judicial screening pursuant to 28 U.S.C. 1915(e)(2). Thus, Plaintiff's motion for the Clerk to issue summons #5 is denied. (Ordered by Judge James Wesley Hendrix on 12/2/2021) (amg) |
