Filing 25 ORDER. The Court has considered Plaintiff's request for "a Gag Order so this civil suit does not bleed into my Criminal Appeal case", Doc. #22 , and finds that it should be DENIED in all things. Plaintiff provided no legal basis for his request, and the Court finds no reason to seal the case that outweighs the presumption of public access. Filing 24 NOTICE OF DEFICIENCY AND ORDER. In light of the Southern District's sua sponte severance and transfer of Plaintiff's claims from the earlier case, the Court finds that Plaintiff should have the opportunity to choose whether he wishes to proceed with his claims against the Robertson Unit defendants, or if he wishes to withdraw this case. Therefore, the Court finds that Plaintiff must respond to this Order within 20 days. If Plaintiff wishes to proceed with his claims against the Robertson Unit Defendants, he must pay the filing fee of $402.00 or file with the Clerk a signed notice indicating that he wishes the Court to consider the application to proceed in forma pauperis and certificate of inmate trust account filed with his original complaint in the Southern District of Texas (Docs. 8, 9); and file a complete amended complaint on the court-approved form for civil-rights cases. If Plaintiff wishes to withdraw this case against the Robertson Unit defendants without prepayment of the filing fee or assessment of fees under 28 U.S.C. 1915, he must file with the Clerk a signed notice of dismissal. The Clerk shall mail a prisoner civil rights complaint form, marked "amended," to Plaintiff along with a copy of this Order. Plaintiff filed a letter asking the Clerk to refund the filing fee that he alleges has been paid three times, and seeking to supplement the list of Defendants in this case. See Doc. #19 . Plaintiff also filed a motion to move his case to the docket of Judge James Wesley Hendrix. See Doc. #20 . The motions are denied.
