April 27, 2022 Opinion or Order Filing 13 ORDER TO REPLEAD. The Court ORDERS Breckles to file an amended complaint in which he provides a short and plain statement of the facts supporting his claims against TDCJ Middleton Unit officials Warden Williams, Officer Fields, and Officer Santos. April 21, 2022 Opinion or Order Filing 12 ORDER TRANSFERRING THE CASE TO THE UNITED STATES MAGISTRATE JUDGE. After an initial review under 28 U.S.C. 1915, the Court is of the opinion that this case should be transferred to the docket of the Honorable John R. Parker, United States Magistrate Judge, for further proceedings. This case will now be numbered Civil Action No. 1:22-CV-00019-BU. April 21, 2022 Opinion or Order Filing 11 PLRA FILING FEE ORDER. After reviewing the application, the Court orders the following: Plaintiff is granted leave to proceed in forma pauperis under 28 U.S.C. 1915. Plaintiff will not be assessed an initial partial filing fee because he lacks the requisite funds in his prison account to pay an initial fee; however, plaintiff will be required to pay the full filing fee of $350.00 under the PLRA. Plaintiff must pay the $350.00 in monthly installments as provided in 28 U.S.C. 1915(b)(2). The Clerk will mail a copy of this order to the inmate accounting office or other persons or entity with responsibility for assessing, collecting, and remitting to the Court the interim filing fee payments on behalf of inmates, as designated by the facility in which Plaintiff is confined. **Clerk note: TDCJ Inmate Trust Office has been electronically notified of this order. March 18, 2022 Opinion or Order Filing 9 NOTICE OF DEFICIENCY AND ORDER. Because this lawsuit is separate and apart from the case that was filed in the Eastern District, Plaintiff must pay a separate filing fee. The Court finds that Plaintiff must, within 20 days from the date of this order, pay the $402.00 filing fee or notify the Clerk that he wishes the IFP documents filed in the Eastern District to be Considered in this case. Alternatively, in light of the Eastern District's sua sponte severance and transfer of Plaintiff's claims from the earlier case, Plaintiff will have the opportunity to withdraw this case against the Middleton Unit Defendants. If Plaintiff wishes to have this case dismissed without prepayment of the filing fee or assessment of IFP fees under 28 U.S.C. 1915, he must file a notice of dismissal within 20 days of the date of this order.
