Filing 7 JUDGMENT. For the reasons stated in the Court's Order of even date, It is ORDERED, ADJUDGED, AND DECREED that Plaintiff's civil rights complaint is dismissed pursuant to the three-strikes provision of 28 U.S.C. 1915(g). (Ordered by Senior Judge Sam R Cummings on 11/14/2022) (skf) |
Filing 6 ORDER. Plaintiff has not paid the $402.00 filing and administrative fees. And-as he is well aware-he is not eligible to proceed without prepayment of costs because his claims do not present a claim of imminent danger of serious physical injury. Thus, this case must be dismissed. As a result, it is ORDERED that Plaintiff's Application to Proceed in Forma Pauperis is DENIED, and his civil rights complaint is DISMISSED WITHOUT PREJUDICE as barred by the three-strikes provision of 28 U.S.C. 1915(g). See Brown v. Megg, 857 F.3d 287 (5th Cir.2017); Adepegba v. Hammons, 103 F.3d 383 (5th Cir. 1996), abrogated in part on other grounds by Coleman v. Tollefson, 575 U.S. 532 (2015). Plaintiff may reopen this case by paying the $402.00 filing and administrative fees and filing a motion to reopen within 30 days of the date of this order.
