Order. The Court finds that it lacks jurisdiction to consider Plaintiff's claims, and that transferring the case to the appropriate venue would be futile and a waste of scarce judicial resources. The Court therefore orders Plaintiff's complaint is dismissed without prejudice for lack of jurisdiction. All pending motions are denied as moot. Therefore, by October 2, 2023 (30 days), Plaintiff is ORDERED to pay the $402 filing fee or file an application to proceed in forma pauperis on the approved form with the required certificate of inmate trust account. Plaintiff's failure to comply with this order may result in the dismissal of this action under Federal Rule of Civil Procedure 41(b). The Clerk will mail an application to proceed in forma pauperis to Plaintiff along with a copy of this order.
