ORDER. Before the Court is the plaintiffs' Notice of Nonsuit. Dkt. No. #6 . The Court has construed this notice as a motion for voluntary dismissal under Federal Rule of Civil Procedure 41(a)(1)(A)(i). Because the plaintiffs' notice did not contain proof that the defendant had assented to the dismissal, and because the defendant had filed an answer in state court, this Court must deny the plaintiffs' motion to voluntarily dismiss this case. Should the plaintiffs wish to dismiss this case, they must comply with Federal Rule of Civil Procedure 41, as well as any other applicable law.
