Filing 9 ORDER.The Court previously ordered the Parties in case No. 1:23-CV-143-C and case No. 1:23-CV-235-C to show cause why the two cases should not be consolidated because they both appear to arise out of the same alleged incident and assert many of the same factual allegations and circumstances. The Parties failed to respond. As such, the Court finds that the two aforementioned civil actions raise common questions of law or fact, enough that they should be consolidated into one civil action pursuant to Fed. R. Civ. P. 42(a). All future filings must bear the number 1:23-CV-143-C. The Court directs the Clerk to consolidate No. 1:23-CV-235-C into No. 1:23-CV-143-C and transfer all of the present pleadings in No. 1:23-CV-235-C to No. 1:23-CV-143-C. The Clerk shall further administratively close Civil Case No. 1:23-CV-235-C. (Ordered by Senior Judge Sam R Cummings on 1/30/2024) (skf) |
Filing 8 ORDER. The Court notes that a previously filed civil action (1:23-CV-143-C) appears to arise out of the same alleged incident and against the same named Defendants. That case remains pending and asserts many of the same factual allegations and circumstances as are alleged in the above styled and -numbered civil action. Thus, the Parties shall SHOW CAUSE within seven (7) days from the date of this Order as to why the two civil actions should not be consolidated for judicial economy. (Ordered by Senior Judge Sam R Cummings on 1/22/2024) (skf) |
