February 2, 2024 Opinion or Order Filing 9 ELECTRONIC ORDER: Plaintiff filed a motion for more definite statement advising the Court of his decision to withdraw his civil-rights complaint. Dkt. No. #8 . Federal Rule of Civil Procedure 41(a) permits a plaintiff to dismiss an action without a court order by filing a notice of dismissal before the opposing party serves an answer. The Court finds that Plaintiff 's motion serves as a self-executing notice of voluntary dismissal under Rule 41(a). This case is now closed, and any pending motions are terminated. Plaintiff is advised that if he refiles his complaint, he must submit his complaint on the court-approved form for prisoner civil-rights cases, and he must pay the $402.00 filing fee or file an application to proceed in forma pauperis with a certified statement of his inmate trust account. January 22, 2024 Opinion or Order Filing 6 ELECTRONIC ORDER AND NOTICE OF DEFICIENCY. Plaintiff must address the following deficiencies: The complaint was not filed on the court-approved form and neither the $405 filing fee nor a request to proceed in forma pauperis was submitted. Therefore, by February 22, 2024 (30 days), Plaintiff is ORDERED to (1) file the civil-rights complaint on the approved form, and (2) pay the $405 filing fee or file an application to proceed in forma pauperis on the approved form with the required certificate of inmate trust account. Plaintiff's failure to comply with this order may result in the dismissal of this action under Federal Rule of Civil Procedure 41(b). The Clerk will mail an application to proceed in forma pauperis, and a prisoner civil-rights complaint form marked "amended," to Plaintiff along with a copy of this order.
