For the reasons stated within and as explained in the government's response, the Court construes Thompson's motion as a civil complaint and dismisses it for lack of jurisdiction and for failure to state a claim. The Court instructs the Clerk to terminate the motion in the criminal action and use the motion to open a new civil case under 28 U.S.C. 1331 (NOS 540), assigned to the undersigned United States District Judge.
