Filing 24
ORDER DIRECTING SERVICE BY THE UNITED STATES MARSHAL AND FOR DEFENDANT TO ANSWER. The Clerk is directed to complete form USM-285 and issue summons to Defendant H. Haught. The Defendant may be served at the Abilene Police Department, 4565 South 1st. Street, Abilene, TX 79605. The Clerk of the Court shall provide the form USM-285, the completed summons, copies of the Plaintiff's Amended Complaint (Dkt. No. #7 ), his response to the Magistrate Judge's questionnaire (Dkt. No. #20 ), the Order of Partial Dismissal (Dkt. No. #22 ), and this Order to the USM for each of the remaining named Defendants. Defendant Haught must, within sixty (60) days from service of this Order, file a written answer to the relevant claims or other responsive pleading in accordance with Rule 12 of the Federal Rules of Civil Procedure. No further motions or pleadings may be filed by Turner until the Defendant has filed an answer, motion, or other responsive pleading, and the Court has entered its scheduling order. THIS CASE WILL BE STAYED AND ADMINISTRATIVELY CLOSED PENDING THE FILING BY DEFENDANTS OF THEIR ANSWER, MOTION, OR OTHER RESPONSIVE PLEADING, OR UNTIL FURTHER ORDER. JUDGMENT. Turner's Fifth Amendment false arrest claims, Fifth Amendment Miranda rights claims, and Fourteenth Amendment denial of medical care claims against all Defendants are DISMISSED with prejudice for failure to state a claim. This is a final judgment with respect to the foregoing claims and Defendants. (Ordered by Magistrate Judge John R. Parker on 3/30/2026) (skh)

Filing 22
ORDER OF PARTIAL DISMISSAL. In all, Turner alleges claims against the following parties: (1) Officer T. Barrett, (2) Officer H. Haught, (3) Officer T. Moreno, (4) Officer F. Cisneros, and (5) Officer R. Pena-Perez. Turner also seeks to assert claims against Taylor County based on the conduct of the above defendants. The Clerk is directed to conform the docket to reflect this change. For the reasons herein, the Court concludes thatTurner's Fourth Amendment excessive force claim against Officer H. Haught SURVIVES judicial screening; and Turner's remaining claims against all defendants are DISMISSED with prejudice for failure to state a claim. Turner has also filed a Motion for Order of Restraint; in it, he requests immediate release because of the delay in prosecution and a Court order that the defendants refrain from harassing him, from selective, vindictive, or retaliatory prosecution, and from criminal profiling. Dkt. #13 . Turner provides no evidence or factual allegations that justify such an order, and as discussed the defendants have probable cause to arrest and prosecute Turner. The Court therefore DENIES Turner's Motion for Order of Restraint. Officer #1 changed to Officer T Barrett and Officer #2 changed to Officer H Haught. Defendants Taylor County, T Moreno, F Cisneros and R Pena-Perez added and terminated. Party "All Other Officers of Abilene Police Involved in Incident Within terminated." (Ordered by Magistrate Judge John R. Parker on 3/30/2026) (skh)
