FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS OF THE UNITED STATES MAGISTRATE JUDGE. For the reasons herein, the undersigned RECOMMENDS that the Court:(1) DISMISS Bermudez's claims against the State of Texas and DFPS with prejudice as barred under the Eleventh Amendment; and (2) DISMISS Bermudez's claims against the remaining Defendants without prejudice for failure to state a claim on which relief may be granted. Having completed the preliminary screening of Bermudez's claims, the undersigned ORDERS that this case be TRANSFERRED back to the docket of the United States District Judge and designated as Civil Action No. 1:25-CV-00239-H. ORDER TO DEMONSTRATE REPRESENTATIVE AUTHORITY. Because Goble is, by his own admission, not representing Bermudez as a licensed attorney, Dkt. No. 1-2 at 2, his role as her constitutional advisor is legally indefensible. Bermudez's filings, to the extent they reflect Goble's statements, affidavits, or signatures, will not be considered by the Court for any purpose.
