Date Filed Document Text
May 21, 2026 Opinion or Order Filing 4 FINAL JUDGMENT. For the reasons stated in the Court's Order (Dkt. No. #3 ), it is ordered, adjudged, and decreed that the petition for a writ of habeas corpus (Dkt. No. 1) is denied with prejudice. The Clerk of the Court is directed to close the case (Ordered by Judge James Wesley Hendrix on 5/21/2026) (amg)
May 21, 2026 Opinion or Order Filing 3 ORDER. Regalado Araiza, as an "applicant for admission," is properly detained without bond under Section 1225(b)(2)(A). Buenrostro-Mendez, 166 F.4th at 498. And the Due Process Clause does not require a bond hearing in these circumstances. Thus, the petition for a writ of habeas corpus (Dkt. No. 1) is denied. To the extent Regalado Araiza sought a preliminary injunction or temporary restraining order (Dkt. No. 1 at 15), that request is denied as moot. The Clerk of Court is directed to serve this Order electronically on the United States Attorney's Office for the Northern District of Texas pursuant to the current Service of Process Agreement for federal habeas petitions under 28 U.S.C. 2241. Attorney Ann Cruce-Haag-DOJ and Brian Walters Stoltz-DOJ for Respondents added. (Ordered by Judge James Wesley Hendrix on 5/21/2026) (amg) . Modified on 5/21/2026 (amg).
