Weeks, and Walker County's Rule 12(b)(6) Motion to Dismiss; and denies as moot Defendants Barbara Hale, David P. Weeks, and Walker County's Rule 12(b)(3) Motion to Dismiss. The court dismisses with prejudice all claims against Judge Gaines, DA Weeks and Judge Hale in their individual and official capaci ties. The court also dismisses with prejudice all claims against Defendants City of Huntsville and Walker County. Plaintiff is to effect service on the State of Texas by 10/31/2008, or inform the court in writing whether he intends to maintain this action against the State.
