Filing 162 Amended Memorandum Opinion and Order. Plaintiffs failed to prove by a preponderance of the evidence that the USPS breached the lease. The USPS proved by a preponderance of the evidence that Plaintiffs constructively evicted it from the leased pro perty and defaulted on the lease effective June 30, 2007. Plaintiffs are liable to the USPS for relocation costs in the amount of $248,999. The USPS is liable to Plaintiffs for$75,038.69, including damage to the leased property in exces s of ordinary wear and tear in the amount of $27,425 and unpaid rent and taxes in the amount of $47,613.69 for the period January 1, 2007, through June 30, 2007. Accordingly, the USPS shall recover from Plaintiffs the amount of $173,960.31,5 plus post judgment interest at the rate of 0.14% per annum.
