ORDER: The court determines that the 41 findings and conclusions are correct in part, and are therefore accepted in part. Accordingly, the court dismisses without prejudice all claims brought by any Plaintiff except for Broderick. Because Broderi ck initially filed this action and has paid the filing fee, her claims may go forward. Broderick, however, is directed to file an amended pleading no later than 12/15/2008 setting forth the claims that she brings on her behalf. Failure to file an ame nded pleading by this date will subject Plaintiff's action to dismissal for want of prosecution or failure to comply with a court order. Every other Plaintiff must file his or her own individual complaint with the court and pay the filing fee of $350. (All pending motions termed. See Order for specifics.) (Ordered by Judge Sam A Lindsay on 11/14/2008) (twd)

FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE on case: The Court recommends that this complaint be dismissed without prejudice and the clerk of court be directed to open new civil actions for each of the named Plainti ffs. Each Plaintiff should be required to file a separate complaint asserting her individual claims and pay the $350 filing fee, or file a proper request to proceed in forma pauperis. Additionally, all pending motions should be denied without prejudice. (Signed by Magistrate Judge Paul D Stickney on 9/23/2008) (twd)

ORDER: The court overrules as moot each of Plaintiffs' objections and determines the transfer of this case is unwarranted. The court determines that the findings and conclusions are incorrect and are rejected. The court, having decided not to transfer this case, denies Plaintiff Broderick's 30 request for a hearing. The court denies as moot her 30 request for a thirty-day stay because there is no scheduling order in this case, and Plaintiff has ample time to obtain counsel to appear on her behalf and others. (Signed by Judge Sam A Lindsay on 9/4/2008) (twd)
