FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: It is recommended that the District Court DISMISS Plaintiff's complaint without prejudice for lack of subject matter jurisdiction unless he shows that he has satisf ied or is excused from satisfying the jurisdictional requirements of the Federal Tort Claims Act and 26 U.S.C. §§ 7422 and 7433 or states some other valid basis for federal jurisdiction.
