Memorandum Opinion and Order. The June 5, 2009 motion to dismiss of defendants David Berkebile and Joseph Capps, M.D. 23 is granted. Plaintiff Kevin Cooper is allowed 30 days to file an amended complaint that states a claim on which relief can be granted. The court declines to adopt the August 18, 2009 findings and recommendation of the United States Magistrate Judge 36 .
