Filing 41 MEMORANDUM OPINION AND ORDER. The 29 12/30/10 motion of defendant Methodist Richardson Medical Center Foundation, Inc., d/b/a Methodist Richardson Medical Center to dismiss for lack of subject matter jurisdiction is denied, and its alternative mot ion for summary judgment is granted. Plaintiff's action against the Foundation is dismissed by Fed. R. Civ. P. 54(b) final judgment filed today. Plaintiff's 27 December 1, 2010 motion for leave to file an amended complaint is granted. He must file his amended complaint within 14 days of the date this memorandum opinion and order is filed. The trial setting of May 16, 2011 is vacated.
