Memorandum Opinion and Order granting in part and denying in part 42 Findings and Recommendations re: 25 MOTION to Dismiss Plaintiff's Original Complaint. The court grants Defendants' Motion to Dismiss with respect to Plaintiff 's fraudulent transfer claim under New York and Texas law and breach of the duty of good faith and fair dealing claim for lack of standing and dismisses them with prejudice.
