July 25, 2012 Opinion or Order Filing 33 Memorandum Opinion and Order granting in part and denying in part 8 Motion to Dismiss: Specifically, the court concludes that Encompass has standing to pursue claims to recover medical benefits but not other claims. Further, the court concl udes that Encompass has stated state law claims for breach of contract and quantum meruit to the extent they are based on non-ERISA governed plans; however, Encompass's quantum meruit claim that is dependent on alleged ERISA plan terms is completely preempted under ERISA and dismissed with prejudice.
