The court hereby lifts its stay of David Sung's deposition. The deposition of Mr. Sung shall proce ed on its originally scheduled date, 2/13/2013, at a time agreeable to the parties. The deposition shall not exceed three hours, each side being limited to 90 minutes, excluding time for any breaks taken during the deposition. (Ordered by Judge Sam A Lindsay on 2/12/2013) (axm)
February 1, 2013	Filing 24 Memorandum Opinion and Order granting in part and denying in part 18 Motion for Summary Judgment: Defendant's Motion for Summary Judgment is granted as to Plaintiff's Title VII and ADEA discrimination claims based on customer assignmen ts and Plaintiff's Title VII employment termination claims. Accordingly, these claims are dismissed with prejudice, together with the withdrawn disability discrimination claim, which Plaintiff abandoned and elected not to pursue in this action . Genuine disputes of material fact exist as to Plaintiff's hostile work environment and ADEA employment termination claims. Defendant's Motion for Summary Judgment is therefore denied as to these claims, which remain for trial. (Ordered by Judge Sam A Lindsay on 2/1/2013) (twd)
