Filing 80 MEMORANDUM OPINION AND ORDER granting in part and denying in part 64 Rule 37(a) Motion to Hold Bart Schnell in Contempt and to Compel Post-Judgment Discovery Responses from Over Drive Marketing, LLC and Bart Schnell. Local Civil Rules 7.1(a) and (h ) require that parties confer before filing an application for attorneys' fees. Plaintiff's counsel and Mr. Schnell are directed to meet face-to-face and confer about the reasonable amount of any requested fees. This face-to-face requiremen t is not satisfied by a telephonic conference. No later than 5/19/2014, the parties must file a joint status report notifying the Court of the results of the conference. Plaintiff is ORDERED to cause a copy of this order to be personally served on Bart Schnell and to then file an affidavit of service. (Ordered by Magistrate Judge David L Horan on 5/5/2014) (ctf) |
Filing 53 MEMORANDUM OPINION AND ORDER granting in part and denying in part 48 Motion for Default Judgment. Because Over Drive has failed to comply with the Court's Order to obtain counsel, the Court STRIKES Over Drive's Answer (doc. 15 ). In a ddition, the Court finds that default judgment is appropriate against Over Drive and that Future World is entitled to statutory damages. However, the Court DENIES Future World's request for $82,500 and ORDERS the parties to appear at a hear ing - the date and time to be specified by separate order - so that it may determine the proper amount to award. Once statutory damages have been determined, the Court will rule on Future World's request for pre-judgment interest, post-judgment interest, and costs and attorneys' fees.
