Filing 30 AMENDED MEMORANDUM OPINION AND ORDER: The court vacates the 21 Memorandum Opinion and Order, and issues this Amended Memorandum Opinion and Order in its place to remove Lewis's name from the style of the case and all references to Lewis as a party to the case and motion for summary judgment. Filing 21 MEMORANDUM OPINION AND ORDER: The court determines that no genuine dispute of material fact exists as to Plaintiff's common law fraud, Texas Deceptive Trade Practices - Consumer Protection Act, and declaratory judgment claims. Defendants are th erefore entitled to judgment as a matter of law on these claims. Accordingly, the court grants Defendants' Motion for Summary Judgment (doc. 11 ) and dismisses with prejudice this action.
