ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE re: 13 Findings and Recommendations on Case re: 3 Complaint, filed by Shenita L A Thompson. The court certifies that any appeal of this action would not be taken in good faith. IT IS THEREFORE ORDERED that Plaintiff's Title VII retaliation and discrimination claims be summarily DISMISSED WITHOUT PREFUDICE for failure to state a claim upon which relief can be granted. However, Plaint iff is granted 14 days from the date of this Order to amend her complaint to state viable Title VII discrimination and/or retaliation claims, if she can. If she fails to do so, the Court will DISMISS WITH PREJUDICE this case, without further notic eification by filing a separate motion to proceed in forma pauperis on appeal to Plaintiff. In the event of an appeal, Plaintiff may challenge this certification by separate motion to proceed in forma pauperis on appeal with the Clerk of the Court, U.S. Court of Appeals for the Fifth Circuit.
