Filing 13 MEMORANDUM OPINION AND ORDER granting in part and denying in part 9 MOTION to Dismiss Plaintiff's Breach-of-Fiduciary-Duty and Estoppel Claims Under Rule 12(b)(6). The court denies Defendants' motion as it relates to Plaintiff's p romissory estoppel claim and grants their motion as it relates to Plaintiff's breach of fiduciary duty claim. Accordingly, the court dismisses with prejudice Plaintiff's claim for breach of fiduciary duty.
