MEMORANDUM OPINION AND ORDER: For the reasons herein stated, Garcia was improperly joined to destroy diversity of citizenship between the parties. Accordingly, the court disregards Garcia's citizenship, holds that complete diversity exists bet ween the parties and that it has jurisdiction to entertain this action, and denies Plaintiff's 5 Opposed Motion to Abstain and to Remand. Further, in light of its ruling herein, the court denies as moot Plaintiff's 5 request for attorney's fees and costs. (Ordered by Judge Sam A Lindsay on 12/30/2014) (twd)
