Accordingly, Plaintiff Claudette Lohr is entitled to Judgment a gainst Frederick Minton and Marlane Minton, jointly and severally, in the amount of $540,000.00 in actual damages and $55,873.84 in attorneys' fees and expenses, for a total judgment of $595,873.84, plus postjudgment interest. Claims 2, 3, and 4 are hereby dismissed with prejudice for fai lure to state a claim under Rule 12(b)(6) of the Federal Rules of Civil Procedure. Claims 6, 10, 11, and 12, as alleged against Defendant McGlamery, are dismissed without prejudice for failure to satisfy the pleading requirements of Rule 9(b) and fo r failure to state a claim under Rule 12(b)(6) of the Federal Rules of Civil Procedure. The deadline for Plaintiff to file an amended pleading to cure the pleading deficiencies with respect to Claims 6, 10, 11, and 12 against Defendant McGlamery is 4/20/2017.
