Filing 117 MEMORANDUM OPINION AND ORDER granting 81 Motion Entry of Order Allowing Advancement of Defense Costs, and denying 87 Motion to Join filed by Ash Narayan & 103 Motion to Join. The Court permits Hiscox to advance defense costs to Movant s. The Movants stand to suffer immediate harm if they are not advanced defense costs. In contrast, the Receiver has no current right to insurance payments. This decision does not resolve a potential non-ripe dispute between Movants and Rudoy. No defense costs or proceeds from the Policy shall be paid to, for, or on behalf of Narayan. (Ordered by Chief Judge Barbara M.G. Lynn on 2/2/2017) (epm) |
