Filing 26 MEMORANDUM OPINION AND ORDER: The court grants Defendant City of Irving's 8 Motion to Dismiss; grants Defendant Irving Independent School District's 10 Motion to Dismiss and denies as moot its Motion to Strike; grants Defendant Danie l Cummings's 11 Motion to Dismiss and denies as moot his Motion to Strike; and denies as moot Defendant Irving Independent School District and Daniel Cummings's Joint 22 Motion to Stay Discovery Pending Resolution of Motions to Dismiss . The court believes, because of Supreme Court and Fifth Circuit precedent, that Plaintiff should be permitted an opportunity to amend his pleadings with respect to those allegations that are factually deficient.
