Filing 39 MEMORANDUM OPINION AND ORDER: Plaintiff's 22 motion is GRANTED in part and DENIED in part, and the defendant's 25 motion is GRANTED in part and DENIED in part. To the extent that Arbitrator Jennings ruled on the merits of Southwest' ;s fourth grievance, that portion of his award is VACATED. The remainder of Arbitrator Jennings's award, the portions that address threshold issues related to arbitrability, is AFFIRMED. Accordingly, the grievance is REMANDED to arbitration before a new arbitrator -- to be selected pursuant to the terms of the parties' CBA -- for a hearing on the merits. (Ordered by Senior Judge A.
