January 29, 2019 Opinion or Order Filing 4 ELECTRONIC Order and Notice of Deficiency. Petitioner Mickey Frank Pryor must address the following deficiency: Petitioner filed a document in this Court titled Notice of Appeal Pursuant to the State Court's Decision of Appellant's 11.07 Habeas Application. Doc. #3 . While the allegations within the pleading appear to suggest it is a habeas action attacking the validity of a state criminal conviction, the case number listed in the style/caption of the pleading (No. W08-00815-X(B)) is not a case number in this Court and the pleading is not submitted on a federal habeas form. Consequently, the Court cannot determine if Petitioner intended to file his pleading in this Court or in state court. In the event Petitioner intends to proceed in federal court, he is ORDERED to file a petition on the federal habeas form and pay the $5.00 filing fee or submit a request to proceed in forma pauperis, along with a certified statement of the balance in his inmate trust account, by 2/28/2019. PETITIONER'S FAILURE TO COMPLY WITH THIS ORDER MAY RESULT IN THE DISMISSAL OF THIS ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(b). The Clerk of the Court is directed to provide to Petitioner, with service of this Order, a form application to proceed in forma pauperis and a standard form petition for cases filed under 28 U.S.C. 2254 (labeled amended).
