June 11, 2019 Opinion or Order Filing 8 FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE re: #6 Objection. Because Defendants failed to establish that the Court has diversity jurisdiction over this matter and removal is barred by 28 U.S.C. 1441(b)(2), the Court should GRANT Plaintiff's Motion to Remand #6 and REMAND this action to the Justice of the Peace Court, Precinct 4, Place 2, Dallas County, Texas. May 10, 2019 Opinion or Order Filing 5 Order and Notice of Deficiency: Defendants have wholly failed to allege-much less prove-that the value of the right to occupy or possess the property exceeds the jurisdictional minimum. Because Defendants are representing themselves, the Court will grant them an opportunity to establish that federal jurisdiction over this removed case is proper. In light of this authority, the Court invites Plaintiff to advise the Court in writing, through a filing made no later than 6/7/2019, whether it objects to removal and moves for remand based on Defendants allegations of Texas citizenship or on any other procedural or jurisdictional grounds. Defendants are likewise invited to file a brief, by 6/7/2019, addressing the procedural propriety of removal and the basis of this Court's jurisdiction. Deadline to cure the deficiency is 6/7/2019. (Ordered by Magistrate Judge Rebecca Rutherford on 5/10/2019) (ndt)
