Filing 8 ORDER REGARDING SUBJECT MATTER JURISDICTION: Federal courts have an independent duty to examine their own subject matter jurisdiction. It thus does not appear that the Court possesses subject matter jurisdiction over Latin's claims. But, because he is proceeding pro se, the Court will grant him an opportunity to address these concerns. The Court therefore ORDERS Latin to file no later than October 10, 2019 a written response to this order to show the Court that it has subject matter jurisdiction over this lawsuit. Failure to comply with this order will result in a recommendation that this action be dismissed for either lack of subject matter jurisdiction under Federal Rule of Civil Procedure 12(h)(3) and/or failure to prosecute and obey an order of the Court under Federal Rule of Civil Procedure 41(b). (Ordered by Magistrate Judge David L. Horan on 9/10/2019) (ndt) |
