February 6, 2020 Opinion or Order Filing 11 FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE. Pro se Plaintiff Darryl Carter filed a civil action to enjoin Defendants from arresting and prosecuting him for criminal trespass for sleeping on public benches at Dallas Love Field Airport. The Court granted Carter leave to proceed in forma pauperis and withheld issuing process pending judicial screening. The Court recommends that Carter's First Amendment claims and his claims against the Dallas Police Department be DISMISSED with prejudice pursuant to 28 U.S.C. 1915(e)(2). The Court further recommends Carter's Eighth and Fourteenth Amendment claims be DISMISSED without prejudice for lack of subject-matter jurisdiction because Carter does not have standing.
