May 29, 2020 Opinion or Order Filing 4 ORDER entered per #3 Order: Hill is prohibited from seeking in forma pauperis status in this court in an attempt to initiate an action in this court at any time within five years from the date of this order. The court further ORDERS that Hill pay to the clerk of court Three Hundred and 00/100 Dollars ($300.00) as a penalty for his frivolous filings, and that the clerk of court not accept any further filings, whether on an in forma pauperis basis or otherwise, from Hill until the clerk has proof that Hill has paid such $300.00 penalty. May 29, 2020 Opinion or Order Filing 3 ORDER: The Clerk is DIRECTED to: (1) open a separate civil case for the notice of removal of the action from the 153rd District Court;(2) file a copy of the notice of removal of the action from the 153rd District Court filed in this case, (see doc. 10 at 1-2), in the new case; (3) directly assign the new case to the same District Judge and Magistrate Judge as in this case;(4) file a copy of this order in each case;(5) file a copy of the Sanctions Order in each case; and (6) mail a copy of both orders as well as Local Civil Rule 81.1 to Defendant. Because Defendant is still subject to the Sanctions Order, he may not seek to proceed in forma pauperis in any case for five years from the date of that order 4/18/2022. He must therefore pay the full filing fee for this case and for the new case. He is hereby ORDERED to: (1) pay the $400.00 filing fee for this case within SEVEN (7) days from the date of this order. (2) pay the $400.00 filing fee for the new case within SEVEN (7) days from the date of this order.(3) file an amended notice of removal in each case that complies with the requirements of 28 U.S.C. 1446 and Local Civil Rule 81.1 within SEVEN (7) days from the date of this order. As noted in the Sanctions Order, Defendant has been warned repeatedly about filing frivolous and malicious actions. He is hereby WARNED that if he does not comply with this order and/or persists in filing frivolous and malicious actions, additional sanctions may be imposed.
