Order: Pruitt's claims against Progressive are hereby DISMISSED without prejudice pursuant to FED. R. CIV. P. 41(a)(2). The court DENIES as moot Progressive's motion to dismiss (docket entry #10 ), Pruitt's motion to leave (docket entry #27 ), and Progressive's request for ruling (docket entry #31 ).
