August 3, 2020 Opinion or Order Filing 2 Order: Hardin's motion for relief from judgment under for Rule 60(b)(6) is construed as a successive habeas corpus petition and transferred to the United States Court of Appeals for the Fifth Circuit. The clerk is directed to open and close, for administrative purposes, a new civil action (nature of suit 530, assigned to the same District Judge and Magistrate Judge as this case) based on the finding that the Rule 60(b) motion is a successive application. The clerk is directed to effect the transfer in the newly opened case. Habeas corpus petition is successive, and the clerk is directed to transfer the matter to the Fifth Circuit Court of Appeals.
