JUDGMENT: It is ORDERED that Defendants' #52 Rule 12(b)(6) motion is GRANTED with respect to Plaintiffs' federal trade-secrets claim, and Plaintiffs' federal trade secrets claim against Defendants is DISMISSED with prejudice. Additionally, the Court DECLINES to exercise supplemental jurisdiction over Plaintiffs' remaining state-law claims, and those claims are DISMISSED without prejudice. Finally, Defendant Madison Realty Capital LP, Marc Zegen, and Joshua Zegen's #54 Rule 12(b)(2) motion [ECF No. 54] is DENIED as moot. ELECTRONIC ORDER denying #20 Motion for Discovery. As a general rule, a party may not seek discovery from any source before the parties have conferred as required by Rule 26(f). But in some cases, a court can accelerate the timing of discovery. An increasing majority of district courts, including several in the Fifth Circuit, have adopted a good cause standard to determine whether to permit expedited discovery. In determining whether good cause exists, courts consider: (1) whether a preliminary injunction is pending; (2) the breadth of the discovery requests; (3) the purpose for requesting the expedited discovery; (4) the burden on the defendants to comply with the requests; and (5) how far in advance of the typical discovery process the request was made. The burden of showing good cause is on the party seeking the expedited discovery, and the subject matter related to requests for expedited discovery should be narrowly tailored in scope. Having considered the relevant factors, the Court finds Plaintiffs have not shown good cause exists for accelerating discovery. Plaintiffs have filed a motion for a TRO and a preliminary injunction, but that fact is not dispositive. Indeed, it is outweighed by the other factors. Namely, the written discovery requests, seeking, among other things, [a]ll documents, communications, and materials that discuss or refer to the Land, the Loan, or the Project in any manner, are overly broad. Plaintiffs do not need to discover, prior to the hearing and on an expedited basis, all the evidence they would need to ultimately prove their case. Plaintiffs also seek four depositions, including one from a non-party and another from a defendant who has not yet filed an answer. But Plaintiffs have not proposed any time limits for the depositions, nor have they proposed to limit the depositions to topics applicable to their request for preliminary injunctive relief. Requiring Defendants and the non-party to comply with these requests on an expedited basis at this stage of the proceeding would be unreasonably costly and overly burdensome. However, Federal Rule of Civil Procedure 15 provides that "[a] party may amend its pleading as a matter of course within: (A) 21 days after serving it, or (B) if the pleading is one to which a responsive pleading is required, 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b), (e), or (f), whichever is earlier." Fed. R. Civ. P. 15(a)(1). If a party wishes to amend its pleading outside Rule 15(a)(1)'s time frame, it must obtain the court's leave or the opposing party's consent. See id. 15(a)(2). Defendants filed their Rule 12(b) motions on November 25, 2020, placing any December 28 amendment beyond Rule 15(a)(1)'s timing. Plaintiffs also do not contend they filed their First Amended Complaint with Defendants' consent. Thus, Plaintiffs' First Amended Complaint was improperly filed without leave of court.
