Accordingly, the Clerk of the Court is directed to: (1) terminate the motion in this criminal case; (2) open a new petition for a writ of habeas corpus under 28 U.S.C. 2241; (3) directly assign the new case to the same District Judge and Magistrate Judge as in this criminal case; and (4) docket a copy of the motion and this order in the new case.
