May 5, 2021 Opinion or Order Filing 5 ELECTRONIC ORDER AND NOTICE OF DEFICIENCY. Plaintiff Jesus Sandoval must address the following deficiency: The Court severed Plaintiff's civil rights claims from his letter motion for compassionate release. See Doc. #3 . Plaintiff is now advised that the civil rights action is subject to the filing fee provisions of the Prison Litigation Reform Act (PLRA). See Complaint form at page 2, paragraph 3 for filing fee information under the PLRA. Accordingly, to the extent that Plaintiff seeks to proceed with a new civil rights action, he is GRANTED until June 3, 2021 to: (1) file a civil rights complaint on the court-approved form and (2) pay filing and administrative fees of $402.00 or file an application to proceed in forma pauperis with the required certificate of inmate trust account. See N.D. Tex. Misc. Ord. 14 (requiring inmates to file civil rights complaints and motions to proceed in forma pauperis on the court-approved forms). If Plaintiff did not intend to file a lawsuit at this time, he may file a Notice of Dismissal and the case will be closed without the assessment of a filing fee. FAILURE TO COMPLY WITH THIS ORDER MAY RESULT IN THE DISMISSAL OF THIS ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(b).The Clerk of the Court is directed to provide to Plaintiff, with service of this Order, a prisoner civil rights complaint form (labeled amended and reflecting this case number) and a prisoner form motion to proceed in forma pauperis. The Court will then issue a deficiency order in the new action, cautioning Defendant that, to the extent he seeks to proceed, he will need to submit a Complaint on the court-approved form, along with filing and administrative fees of $400.00 or a request to proceed in forma pauperis.
