June 9, 2022 Opinion or Order Filing 9 ELECTRONIC ORDER: Before the Court is Plaintiff's First Amended Complaint (the "Amended Complaint") (Doc. No. 8). Per Fed. R. Civ. P. 15(a)(1), "A party may amend its pleading once as a matter of course within: (A) 21 days after serving it, or (B) if the pleading is one to which a responsive pleading is required, 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b), (e), or (f), whichever is earlier." When a party cannot amend a pleading as a matter of course, the party may only amend "with the opposing party's written consent or the court's leave." Fed. R. Civ. P. 15(a)(2). Here, Plaintiff filed her Original Complaint in Texas state court on March 15, 2022. See Doc. No. 1-3 at 1-9. Defendants accepted service on March 31, 2022. Doc. No. 1 at 2. Defendants filed their Answer in state court. See Doc. No. 1-3 at 29-34. Being outside the twenty-one days after service of the Original Complaint, Plaintiff may not currently amend as a matter of course. Also, Plaintiff did not seek leave of this Court to amend her Complaint, nor does it appear that Plaintiff secured the consent of Defendants. Therefore, the Court ORDERS Plaintiff to file a certificate of conference evidencing Defendants' consent to the filing of the Amended Complaint by June 16, 2022. If Plaintiff cannot obtain Defendants' consent, the Court will unfile the Amended Complaint; Plaintiff can then separately motion the Court for leave to amend per Fed. R. Civ. P. 15(a)(2).
