ELECTRONIC ORDER: Before the Court is the parties' Stipulation to Amend Plaintiff's Amended Complaint and Withdraw Claims Against [Defendants] Trumont Investment Group LLC and Lardner Group LLC (the "Stipulation") (Doc. No. 17). The Stipulation is signed by Plaintiff's national counsel and counsel for Defendant Trumont Investment LLC. Defendant Lardner Group LLC was served on May 17, 2022 (Doc. No. 9) but has not yet answered or otherwise appeared in this case. In the Stipulation, the parties stipulate and agree that "Plaintiff's Amended Complaint shall be further amended to withdraw claims made against Trumont Investment Group LLC and Lardner Group LLC without prejudice." There is no further explanation. It is unclear to the Court what the parties are attempting to effectuate with the Stipulation. If Plaintiff intends to amend its Complaint, it may do so pursuant to Federal Rule of Civil Procedure 15(a). If the purpose of the Stipulation is a voluntary dismissal of these Defendants under Rule 41(a), the parties must explicitly state as much or indicate which claims are dismissed as to which Defendant. To be clear, the parties' Stipulation as filed is of no effect. Finally, but no less important, all documents filed with the Court must be signed by local counsel pursuant to the undersigned's Judge Specific Requirements under "I. Case Management Procedures" located on the website for the United States District Court Northern District of Texas. ORDER: Federal courts are vested with subject matter jurisdiction over all civil actions "arising under the Constitution, laws, or treaties of the United States," or where the case in controversy exceeds $75,000 and is between citizens of different states, or between citizens of a state and citizens or subjects of a foreign state. 28 U.S.C. 1331, 1332(a)(1)-(2). The Court Orders Plaintiff to amend its Complaint within ten (10) days from the date this order is signed to properly allege the citizenship of Defendants Trumont Group LLC, Trumont Construction LLC, and Lardner Group LLC, respectively, and to allege whether subrogation is total or partial, and if partial, the citizenship of the relevant entities. See 28 U.S.C. 1653. Also, each party's Certificate of Interested Persons/Disclosure Statement must properly reflect the respective citizenship of all parties, which includes each member of the Defendant LLCs.Failure to comply with this order will result in dismissal of the case without prejudice and without further notice.
