Filing 47 Memorandum Opinion and Order: Despite the evidence of Marcus's dilatory tactics, and the resulting prejudice to Stacy, the Court recognizes that dismissal is a "harsh and drastic sanction" and therefore, the Court ORDERS Marcus to fi le within 21 days of entry of this order an appeal brief detailing with particularity the grounds for this appeal, the relief sought, and the legal argument necessary to support it. Stacy will then have 14 days to file a response brief, and Marcus wi ll have 7 days from the date of Stacy's response to file a reply, consistent with local rules 7.1 and 7.2. The Court will consider any attempts to file unnecessary motions or other documents, beyond the appeal brief just mentioned, as further ev idence of the obstinate dilatory tactics warranting dismissal of this action. Likewise, failure to file an appeal brief within 21 days will warrant dismissal of this action under Federal Rule of Civil Procedure 41(b). (Ordered by Judge Brantley Starr on 11/14/2023) (cea) |
