Because of the agreement and stipulation of Plaintiff and the amount in controversy does not exceed $75,000, the court lacks subject matter jurisdiction over this action, and remand to state court is mandatory. Accordingly, the court directs the clerk of court to remand this action to Dallas County Court at Law Number 5, Dallas, Texas.
