Filing 6 SECOND NOTICE OF DEFICIENCY AND ORDER: Darrell Carlin Ferguson must address the following deficiency: It is still not clear from the filing whether the plaintiff seeks to sue private parties, whether he seeks to file a civil rights lawsuit under 42 U.S.C. 1983 based on actions taken against him in the prison facility where he is incarcerated, or whether he is challenging a disciplinary proceeding against him under 28 U.S.C. 2254. The plaintiff's filing does not comply with the requirement in Fed. R. Civ. P. 8(a). The plaintiff did not file his complaint on the proper form. If plaintiff wishes to proceed with a civil lawsuit. He must either pay the $402 filing fee or submit an application to proceed in forma pauperis with the required certificate of inmate trust account. If he is seeking to challenge a disciplinary proceeding, he must file a habeas action by completing and returning the enclosed form used in this Court for actions filed under 28 U.S.C. 2254. He must also either pay the $5 filing fee for a habeas case or submit an application to proceed in forma pauperis with the required certificate of inmate trust account. Failure to comply with this order may lead to dismissal for failure to prosecute pursuant to FRCvP 41(b). Deadline to cure the deficiency is 30 days.
