ELECTRONIC Order and Notice of Deficiency: Movant Cesar Contreras-Orosco must address the following deficiency: Movant seeks relief under 28 U.S.C. 2255, but did not file his motion on the appropriate form. See Rule 2, of the Rules Governing Section 2255 Proceedings (setting out the pleading requirements and providing that the motion must "substantially follow" either the form appended or a form prescribed by local rule). Movant filed only a Memorandum of Points and Authorities. See Doc. #1 . Therefore, Movant is ORDERED to complete and file the enclosed form used in this Court for actions filed under 28 U.S.C. 2255 by February 24, 2023. FAILURE TO COMPLY WITH THIS ORDER MAY RESULT IN THE DISMISSAL OF THIS ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(b). The Clerk of Court is directed to provide to Movant, with service of this order, a copy of the AO 243 standard form motion to vacate sentence under 28 U.S.C. 2255 (listing this case number), which is also available for downloading at https://www.uscourts.gov/forms/civil-forms/motion-vacateset-aside-sentence-motion-under-28-usc-ss-2255. Any amended Section 2255 motion will supersede (take the place of) Movant's previous filing. Consequently, Movant must state all claims in any amended Section 2255 motion filed. (Ordered by Magistrate Judge Renee Harris Toliver on 1/27/2023) (chmb)
